Access Smart®, LLC Warranty & Return Policy

I.    Access Smart Corporation Warranty

Access Smart warrants each Product listed below to be free from defects in materials and assembly in the course of normal use and service. The warranty period commences with the date of shipment to the original purchaser and extends for the time indicated below:

B.        Exclusive Warranty Remedy

In the event of a breach of warranty, Access Smart will replace, credit, or refund Customer with Product at the price of the Product paid by Customer, provided that the warranty claim is delivered to Access Smart by the Customer during the warranty period in accordance with the terms of this warranty. Unless otherwise requested by an Access Smart representative, return of the failed product(s) is required to receive replacement, credit, or refunds. All returned Product(s) shall then become the property of Access Smart and will not be returned back to customer.

In the event Access Smart chooses to perform a Product evaluation within the thirty (30) day holding period and no defect(s) is/are found, Access Smart may refuse to replace, credit, or refund the product or purchase price.

C.        Warranty Exclusions

Access Smart shall not be responsible or liable for any damage or loss resulting from the operation or performance of any Product or any systems in which the Product is incorporated. This warranty shall not extend to any ancillary equipment not furnished by Access Smart which is attached to or used in conjunction with a Product, or to any Product which is used with any ancillary equipment which is not furnished by Access Smart.

Additional, Access Smart cannot warrant the Product for the following conditions:

 

  • Cards with locked PINs or PUKs
  • Defects resulting from Customer’s improper testing, operation, installation, maintenance, modification, alteration, or adjustment.
  • Defects or damage from misuse, accident or neglect.
  • Lost or stolen cards or readers.
  • Defects or damage resulting from use of the Product in other than its normal and customary manner.
  • Defects or damage due to lightning or other electrical discharge, floods or other water damage, fire, smoke, terrorism, other acts of nature, or other acts of mankind that are outside the products normal operation and use.
  • Product disassembled or repaired by any person or company not authorized in writing by Access Smart.
  • Modification or abuse of, or tampering with, the Product.
  • Access Smart does not warrant the installation, maintenance, or service of the Product.

THIS WARRANTY SETS FORTH THE FULL EXTENT OF ACCESS SMART’S WARRANTY RESPONSIBILITY. REPLACEMENT, CREDIT OR REFUND IN THE AMOUNT OF THE PURCHASE PRICE PAID FOR THE DEFECTIVE PRODUCT IS THE EXCLUSIVE REMEDY. THIS WARRANTY IS PROVIDED IN LIEU OF ALL OTHER EXPRESS OR IMPLIED WARRANTIES. ALL OTHER WARRANTIES, EXPRESS OR IMPLIED, INCLUDING WITHOUT LIMITATION IMPLIED WARRANTIES OF MERCHANTABILITY AND FITNESS FOR A PARTICULAR PURPOSE ARE SPECIFICALLY EXCLUDED. IN NO EVENT SHALL ACCESS SMART BE LIABLE FOR DAMAGES IN EXCESS OF THE PURCHASE PRICE OF THE PRODUCT, FOR ANY LOSS OF USE, LOSS OF TIME, INCONVENIENCE, COMMERCIAL LOSS, LOST PROFITS OR SAVINGS OR OTHER INCIDENTAL, SPECIAL, OR CONSEQUENTIAL DAMAGES ARISING OUT OF THE INSTALLATION, USE, OR INABILITY TO USE SUCH PRODUCT, TO THE FULLEST EXTENT THAT ANY SUCH LOSS OR DAMAGE MAY BE DISCLAIMED BY LAW.


II.    Access Smart Return Policy

Access Smart Return Policy will refund, regardless of reason, the purchase price, minus any shipping and handling fees, of any Product up to 30-days after purchase price. The customer will contact Access Smart at 949-218-8754 or email service@access-smart.com to receive an RMA authorization number.

Access Smart Return Policy will Replace, Credit or Refund the purchase price, minus any shipping and handling fees, of any Product that is within the standard warranty period and meted the Warranty Statement outline in Section I of this document. The customer will contact Access Smart at 949-218-8754 or email service@access-smart.com to receive an RMA authorization number.

The Customer must comply with the following procedures in connection with any return of Product(s):

A. For Product Returned within 30-Days of Purchase Procedure

1.     Inform Access Smart Customer Service at 949-218-8754 or email service@access-smart.com that Customer wishes to return Product(s). Any reason will be accepted, and any reason information given by the Customer will only be used for Quality Control purposes.

2.     Provide Access Smart Customer Service with the following:

a.         Customer’s name, address, phone number and email

b.         Product name

c.         The reason for the return (used only for quality control).

d.         The original Purchase Order number or date

e.     Credit Card number, expiration date, security code and name on the card used to charge the product.

3.     Access Smart will issue a Return Material Authorization (RMA).

4.     Return the Product(s) with the RMA number clearly marked on the box. All returned Product(s) shall then become the property of Access Smart and will not be returned back to customer. Any package returned to Access Smart without an RMA number will be refused and shipped back to the sender.

6.     Upon receipt and verification of purchase date of returned product with approved RMA number on box, Access Smart will issue a Product refund to the Customer’s credit card within ten (10) working days.

B. For Product In-Warranty Return and Credit Procedure

1.     End users will contact the Customer in regards to warranty returns and credits.

2.     The Customer will contact Customer Service at Access Smart at 949-218-8754 or email service@access-smart.com to receive an RMA authorization number.

3.     Provide Access Smart Customer Service with the following:

a.         Customer’s name, address, phone number and email

b.         Product name

c.         The reason for the return.

d.         The original Purchase Order number or date

e.         Credit Card number, expiration date, security code and name on the card used to charge the product.

f.          Customer will request Replacement, Credit or Refund of the Product.

4.     Access Smart will issue a Return Material Authorization (RMA).

5.     Return the Product(s) with the RMA number clearly marked on the box. All returned Product(s) shall then become the property of Access Smart and will not be returned back to customer. Any package returned to Access Smart without an RMA number will be refused and shipped back to the sender.

7.     Upon receipt of returned Product, Access Smart will evaluate the Product within thirty (30) working days to determine if it meets the Warranty Statement as outlined in Section I of this document. If there is a discrepancy, Access Smart will inform Customer of our findings and disposition of claim.

8.     If the returned Product(s) meets the Warranty Statement the Customer will be issued a Replacement, Credit or Refund based upon the Customer’s request.

9.     If Replacement is requested, Access Smart will replace the returned Product with new Product that best matches the form and function of the original Product. Access Smart will make all efforts to replace the needed Product(s), within a target turnaround of 24 hours after Product Evaluation Review.

10.   If Credit or Refund is requested, Access Smart will either credit or refund the original purchase price to the Customer’s credit card used to purchase the Product within thirty (30) working days after Product Evaluation Review.

C. Product Repair

Product repair services are not provided. Customers will have to order new Product that does not meet the Warranty Statement as outline in Section I of this document.
